MEMBERSHIP AGREEMENT
1. Parties
a) ALLA ZENGİN TARIM ENDÜSTRİ ÜRETİM TURİZM YATIRIM SANAYİ VE DIŞ TİCARET ANONİM ŞİRKETİ, located at Yakuplu Mahallesi 30. Sokak No: 21/6, Beylikdüzü – Istanbul, operating the website www.anatolianbee.com (hereinafter referred to as “Anatolian Bee”).
b) The internet user who becomes a member of the website www.anatolianbee.com (“Member”).
2. Subject of the Agreement
The purpose of this Agreement is to determine the terms and conditions under which the Member may benefit from the website www.anatolianbee.com, owned by ALLA ZENGİN TARIM ENDÜSTRİ ÜRETİM TURİZM YATIRIM SANAYİ VE DIŞ TİCARET ANONİM ŞİRKETİ.
3. Rights and Obligations of the Parties
3.1. The Member declares and undertakes that the personal and other information provided when registering on www.anatolianbee.com is accurate under the law, and that they will indemnify Anatolian Bee for any and all damages that may arise due to the inaccuracy of such information, immediately and in full.
3.2. The Member cannot provide the password assigned by Anatolian Bee to any other person or organization; the right to use the said password belongs exclusively to the Member. All responsibility arising from this and any claims or demands brought against Anatolian Bee by third parties or competent authorities due to unauthorized use shall remain with the Member, and Anatolian Bee reserves the right to claim any compensation and other demands arising from such unauthorized use.
3.3. The Member accepts and undertakes in advance to comply with legal regulations and not to violate them while using www.anatolianbee.com. Otherwise, all legal and criminal liabilities shall solely and exclusively bind the Member.
3.4. The Member may not use www.anatolianbee.com in any way that disrupts public order, violates general morality, disturbs or harasses others, is for an unlawful purpose, or infringes upon the intellectual and copyright rights of others. In addition, the Member may not engage in activities or transactions that prevent or make it difficult for others to use the services (spam, viruses, trojan horses, etc.).
3.5. Ideas and opinions expressed, written, or used by Members on www.anatolianbee.com are entirely the personal views of the Members and bind only the opinion owner. These opinions and thoughts have no connection with Anatolian Bee. Anatolian Bee bears no responsibility for any damages that Members or third parties may suffer due to opinions expressed by Members or third parties.
3.6. Anatolian Bee shall not be liable for the reading of member data by unauthorized persons, or for any damage that may occur to member software and data. The Member has agreed in advance not to claim compensation from Anatolian Bee for any damages they may suffer due to the use of www.anatolianbee.com.
3.7. The Member agrees not to access or use other internet users’ software and data without permission. Otherwise, all legal and criminal liabilities shall rest entirely with the Member.
3.8. The Member who violates one or more of the items listed in this membership agreement shall be personally and legally liable for such violation and shall hold Anatolian Bee harmless from the legal and criminal consequences of these violations. Furthermore, should the matter be brought into the legal domain, Anatolian Bee reserves the right to claim compensation from the Member for non-compliance with the membership agreement.
3.9. Anatolian Bee has the unilateral right to delete the Member’s account and delete files, documents, and information belonging to the customer whenever deemed necessary. The Member accepts this right in advance. In such a case, Anatolian Bee bears no responsibility.
3.10. The software and design of www.anatolianbee.com are owned by Anatolian Bee, and copyright and/or other intellectual property rights relating to them are protected by relevant laws. They may not be used, acquired, or modified by the Member without permission. Other companies and products mentioned on this website are trademarks of their respective owners and are protected within the scope of intellectual property rights.
3.11. For the improvement and development of www.anatolianbee.com and/or within the framework of legal regulations, certain information such as the name of the Internet service provider used to access the site, the IP address, the date and time of access to the site, the pages accessed while on the site, and the Internet address of the website that provided a direct link to the site may be collected.
3.12. Anatolian Bee may disclose the Member’s personal information when legally required, or when it believes in good faith that such disclosure is necessary to: (a) comply with legal requirements or legal processes served on the relevant authorities; or (b) protect and defend the rights and property of Anatolian Bee.
3.13. Anatolian Bee has taken precautions within available means to ensure that the website is free of viruses and similar malicious software. However, for ultimate security, the user must provide their own virus protection system and ensure the necessary security measures. In this context, by accessing the Anatolian Bee website, the Member is deemed to have accepted responsibility for any errors in their own software and operating systems and for the direct or indirect consequences thereof.
3.14. Anatolian Bee reserves the right to change the content of the site at any time, to change or terminate any service provided to users, or to delete user information and data registered on the Anatolian Bee website.
3.15. Anatolian Bee may change, update, or cancel the terms of the membership agreement at any time without prior notice and/or warning. Any provision that is changed, updated, or repealed shall be effective for all Members on the date of publication.
3.16. The parties accept and declare that all computer records belonging to Anatolian Bee shall be taken as the sole and exclusive evidence in accordance with Article 287 of the Code of Civil Procedure (HUMK) and that such records constitute a contract of evidence.
3.17. Under this membership agreement, Anatolian Bee is authorized to send informational emails to the electronic mail addresses and informational SMS messages to the mobile phones of its Members. By approving this membership agreement, the Member is deemed to have accepted the sending of informational emails and SMS messages to their registered contact information.
4. Termination of the Agreement
This agreement shall remain in effect until the Member cancels their membership or until Anatolian Bee cancels the membership. Anatolian Bee may terminate the agreement unilaterally by canceling the membership if the Member violates any provision of the membership agreement.
5. Resolution of Disputes
Istanbul Courts and Enforcement Offices shall have jurisdiction over disputes arising from this agreement.
6. Enforcement
By registering for membership, the Member is deemed to have read and accepted all the provisions of the membership agreement. This Agreement is deemed to have been concluded and entered into force mutually at the time the Member becomes a member.
